Gammatica
Last updated 13 October 2026 · Replaces the version of 11 October 2026
What changed in this version
- A new point 13.13 governs the AI machine: browsing on your behalf, approval, logging in, limits, fees and retention.
Changes in the version of 11 October 2026
- A new point in section 7 governs protection of the free allowance: when no starter AI credit is given and when no free video is given.
- Section 10 states that AI conversations are reviewed automatically, in redacted form, to improve quality.
- Shopify, MyGLS and your own IMAP/SMTP mailbox are added to the Connected Services in section 2; the new section 13.12 covers mailboxes.
- Section 13.5 describes the read-only Google Ads connection; connecting Meta Ads is still in preparation. Under section 13.7, Shopify can now be connected.
- Section 13.11 adds deposits on the booking page: payment goes to the User's own Stripe account.
Changes in the version of 24 September 2026
- Section 6 aligns the free trial with how it actually works: 14 days, no card required; at the end the subscription does not start automatically — the workspace is locked and the data is kept.
- Section 7 governs AI credits (one-time starter allowance, daily free allowance, monthly pack and top-up, expiry), the usage balance, the storage allowance, pro-rata billing of user seats, the grace period after a failed charge, lifetime access and discounts.
- Section 11.1 now covers the own voice feature (voice clone), uploaded video, AI music and podcasts.
- Section 13 gains new subsections: webshop integrations (UNAS, WooCommerce, Shoprenter), data migration (MiniCRM, Asana, Trello), partner applications and MCP clients, the webshop storefront, and publicly published content with the notice procedure for illegal content.
- Connecting ad accounts (Meta Ads, Google Ads) is in preparation; Section 13.5 records this.
These Terms and Conditions (the “Terms”) govern access to and use of the website at https://gammatica.com and the related software, products and services (collectively, “Gammatica” or the “Service”) provided by Gammatica Kft. (the “Service Provider”, “we”, “us”). By accessing the website, registering for, or using the Service, the customer (“Customer”, “User”, “you”) agrees to be bound by these Terms and to comply with all applicable laws. If you do not agree, you must not access or use the Service.
Gammatica is a platform for businesses and organisations. It is not offered to, and may not be used by, natural persons acting as consumers within the meaning of Hungarian and EU law. Because the User is not a consumer, the rules on consumer-protection procedures and conciliation-body procedures do not apply.
We may review and amend these Terms at our discretion. When we do, we will update this page; changes take effect from the date of publication or, where they materially reduce your rights, 30 days after publication. Your continued use of the Service after that date constitutes acceptance of the amended Terms.
These Terms were last updated on 24 September 2026.

2. Definitions (updated)
“Customer Data” means all data, text, files, documents, messages, contacts and other content that you or your authorised users input, upload, connect, generate or store through the Service, including data imported from connected third-party services and including meeting recordings, transcripts and notes produced by the AI Meeting Notetaker. “Authorised User” means an individual you permit to use the Service under your account. “Subscription Period” means the period for which you have paid for access to the Service. “AUP” means our Acceptable Use Policy; “Privacy Policy” means our Privacy Policy. “Connected Service” means any third-party service that you link to the Service with your own account, API key or access token — for example Google Workspace, Microsoft Outlook, Dropbox, Stripe, Számlázz.hu, Billingo, Meta Lead Ads, UNAS, WooCommerce, Shoprenter, Shopify, MyGLS, your own IMAP/SMTP mailbox, MiniCRM, Asana, Trello, Make and Zapier. “AI credit” means the unit in which use of the AI Features is accounted for under Section 7; “workspace” means the separate unit within the Service to which Customer Data, settings, balances and Authorised Users belong.
3. The Service and licence to use
Subject to these Terms and to payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own internal business purposes during the Subscription Period. This is the grant of a licence, not a transfer of ownership. You may not transfer or resell access to any unauthorised third party. The licence terminates automatically if you breach these Terms.
Technical requirements for using the Service: a broadband internet connection; a supported browser (current versions of Google Chrome, Safari, or Firefox); an active username and password; and appropriate access rights.
4. Eligibility
You represent that you are a business or organisation (or an individual acting in a business or professional capacity), that you have the authority to enter into these Terms on behalf of the entity you represent, and that the entity is not subject to applicable sanctions and is not located in an embargoed jurisdiction.
5. Registration and user accounts
To use the Service, you must register and create an account, providing accurate and complete information. By registering, you accept these Terms and the Privacy Policy. A contract for the use of Gammatica is concluded upon successful registration and payment, confirmed by email. A contract concluded via the website is not considered to be in writing and is not separately filed by us; its languages are English and Hungarian.
You may invite and manage Authorised Users within your account. You are responsible for all activity under your account, for keeping login credentials and access tokens secure, and for promptly updating your account information. You must notify us without delay of any unauthorised use. You may manage and update your profile information at any time, and a password-reset function is available from the login screen.
6. Free trial
During the free trial shown at sign-up — currently 14 days from registration — the Service can be used with full functionality. No card details are required to register, and your subscription does not start automatically at the end of the trial: fees are payable only if you subscribe.
If you subscribe during the trial, the remaining trial days are not lost: the first paid period starts when the trial ends. If you have not subscribed by the end of the trial, the workspace is locked: its data can be viewed, but no new data can be added and existing data cannot be modified until you subscribe. The data is kept while the workspace is locked; its deletion is governed by Section 8 and the Privacy Policy. Gammatica AI remains usable in a locked workspace — up to any remaining starter credits and then the daily free AI credits (Section 7) — and deleting the account or the workspace is always available.
We may modify or withdraw trial offers at any time, and may limit trials to one per customer. Trial use is subject to these Terms and the AUP, and we may suspend or terminate trial accounts that we reasonably believe are being abused (for example through the creation of multiple accounts).
7. Fees, billing and taxes (updated)
The services, service packages and applicable fees are set out in our pricing (the “pricing”). Prices may be shown in Hungarian forint, euros or US dollars. Listed prices are net amounts; VAT is charged according to the buyer's country and tax number, under the VAT rules in force. For a buyer registered in another EU Member State with a valid EU VAT number, the reverse-charge rules apply; a customer buying as a business must provide a valid tax number.
- Subscription. You pay a subscription fee for the Subscription Period, the amount of which depends on the number of user seats in the workspace. Subscriptions renew automatically until cancelled. The fee is payable monthly or annually in advance, by card through our payment processor, Stripe Payments Europe Ltd. (Grand Canal Street Lower, Dublin, Ireland). We are not directly responsible for the payment processor’s service.
- Invoice. Within three working days after a fee is credited to us, we issue an electronic invoice to your email address.
- User seats. When a seat is added, we immediately charge a pro-rata fee for the remainder of the Subscription Period. When a seat is removed, the fee for the unused period is not refunded in money: it is credited against your next invoice.
- Failed charge. If the renewal charge fails, we provide a 14-day grace period during which we retry the charge several times and the Service remains available. If the charge has still not succeeded by the end of the grace period, we may place the workspace in the locked state described in Section 6 until the fee is settled.
- Immediate performance. By ordering the Service or paying the fee, you give your express prior consent to immediate commencement of the digital service, acknowledging that, to the extent any withdrawal right would otherwise apply, it ceases once performance has begun.
- Price changes. We may change our fees. We will give reasonable advance notice of price changes, which take effect at the start of your next renewal period; if you do not accept a change, you may cancel before it takes effect.
- AI credits. The AI Features — including text, image, video, audio and music generation and the AI Meeting Notetaker — consume AI credits at the rates shown in the pricing and in the product. (a) Each workspace receives a one-time starter allowance of AI credits, which does not renew monthly and remains available until used. (b) A daily free allowance of AI credits, as shown in the pricing, applies even without a subscription; it does not accumulate and resets daily. (c) A monthly AI credit pack and one-off top-ups can be purchased only alongside an active Pro subscription or lifetime access; credits from the monthly pack and from top-ups that are not used in a given month expire at the end of that month. (d) Automatic top-up can be enabled; the Service may limit the number of automatic top-ups per month to prevent overspending. (e) AI credits cannot be exchanged for money or transferred to another workspace, and consumed credits are non-refundable.
- Protection of the free allowance. (new) The starter AI credit and the free video are there so that the Service can be tried out. (a) If a second Account is created from the same IP address within one hour, or sign-up uses a disposable email address, the new workspace does not receive the starter AI credit or the credit gift given on the second day; sign-up still goes ahead. (b) Until the workspace has subscribed, one free video of up to 5 seconds can be created. If the request names a video model or provider, or points to automated, bulk production, the free video is not given. If the video is not completed because of a technical error, the free allowance is restored. (c) If you believe the system classified you incorrectly, you can request human review at [email protected]. The details of the check are set out in section 2.2 of the Privacy Policy.
- Usage balance. Certain services that immediately incur costs with third parties — such as sending SMS, and email sent from the Service's own sender or from your own domain — are paid from a prepaid usage balance, according to the pricing and the minimum top-up amount shown in the product. When the balance runs out, such sending stops until you top up; automatic top-up can be enabled. This does not apply to messages sent from your own Gmail or Outlook account.
- Storage. Each workspace receives the base storage allowance shown in the pricing, which counts both uploaded and generated files; the allowance can be extended for AI credits, and an extension does not expire. The per-file size limit is shown in the product. When the allowance is full, no new file can be uploaded until space is freed or the allowance is extended.
- Lifetime access. As an offer limited in time and quantity, we may offer lifetime access for a one-time fee, purchasable per user seat for the period and up to the quota stated in the offer. For the seats purchased, lifetime access replaces the monthly or annual Pro subscription fee for as long as the Service is provided — not for the lifetime of the purchaser. AI credits, items paid from the usage balance and storage extensions remain payable according to the pricing alongside lifetime access. Lifetime access is also subject to these Terms, including Sections 8 and 20.
- Discounts. At our discretion we may grant discounts or discount codes (coupons). The amount, duration and conditions of a discount are set by the offer concerned; a discount cannot be exchanged for money or transferred and, unless the offer states otherwise, cannot be combined with other discounts.
8. Term, cancellation and termination
You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the then-current billing period, and the Service remains available until then. Except as required by law, fees already paid are non-refundable.
We may suspend or terminate your access and these Terms with immediate effect on written notice for any breach of these Terms, the AUP or applicable law, for non-payment, or where required to protect the security or integrity of the Service or third parties. On termination, your licence ends and you must stop using the Service. For a limited period after termination, you may export Customer Data where the Service provides that function; thereafter we may delete Customer Data in accordance with the Privacy Policy and applicable retention obligations. Once deleted, data cannot be restored.
9. Acceptable use
Your use of the Service is subject to the AUP, which is incorporated into these Terms by reference. Without limiting the AUP, you must not: modify, copy, create derivative works of, decompile or reverse engineer the Service; remove proprietary notices; mirror or transfer the Service to another server or person; use the Service to abuse, disrupt or gain unauthorised access to any network or system; transmit harassing, indecent, obscene, fraudulent or unlawful material; send unauthorised advertising or spam; harvest data without consent; or infringe the privacy, intellectual-property or other rights of third parties.
10. Customer Data and data protection (updated)
As between you and us, you own and are responsible for Customer Data. You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display Customer Data solely to the extent necessary to provide, secure, maintain and support the Service for you and in accordance with your instructions and the Privacy Policy. We will not use Customer Data to serve advertising and will not use Customer Data to develop, improve or train generalised, non-personalised artificial-intelligence or machine-learning models. We will never sell Customer Data.
Where Customer Data contains personal data, you act as the data controller and we act as the data processor on your behalf. You are responsible for ensuring you have a valid legal basis for the processing, for providing required notices and obtaining required consents, and for the lawfulness of your data processing. To the extent permitted by law, we exclude liability arising from your data processing. Our processing of personal data is governed by the Privacy Policy, available at https://www.gammatica.com/privacy-policy.
To improve the quality of the Service, AI conversations are reviewed automatically every day; before the review, email addresses, phone numbers and account numbers are masked. The result is used solely to improve the Service, as set out in section 2.9 of the Privacy Policy. (new)
11. AI-powered features and disclaimer
The Service includes artificial-intelligence features (the “AI Features”), such as content and text generation; image, video, music and speech generation (including podcasts and narration in your own voice); creation of websites, landing pages, presentations and proposals; summaries, checklists and subtasks, document generation, email-reply suggestions, lead scoring, chatbot functionality, AI agents configured by you, and the transcription and summarising of video meetings described in Section 12. AI requests are routed through OpenRouter, Inc. to third-party model providers, as described in the Privacy Policy.
- Assistance only. AI-generated content is provided for assistance only and is not absolute, final, or legally binding. It may contain inaccuracies, errors or unsuitable content, and you must review and verify it before relying on it.
- Your responsibility. By using the AI Features you accept full responsibility for reviewing, editing and ensuring the correctness, compliance and suitability of any AI-generated content before use. Where AI output contributes to automated processing that could have legal or similarly significant effects on individuals, you must apply meaningful human review.
- No professional advice. AI-generated content does not constitute professional, legal, medical, tax or financial advice.
- No training on your data. Customer Data processed through the AI Features is not used to train generalised AI/ML models. Requests are routed with the AI-training opt-out applied; model providers may process data only to deliver the requested feature and may retain it transiently under their own terms.
- No liability for AI errors. To the maximum extent permitted by law, we exclude all liability for misleading, incorrect, incomplete or unsuitable AI-generated content and for any damages or consequences resulting from reliance on it.
- Usage restrictions. You must not use the AI Features for illegal, misleading or unethical purposes, as further described in the AUP.
11.1. Portrait avatars, own voice, AI images, AI video, AI music and podcasts
- Your warranties regarding uploaded content. You may upload a photograph, video, voice recording or other likeness only if you are entitled to use it and have obtained the consent of every natural person seen or heard in it to having content generated from their likeness or voice by artificial intelligence.
- Own voice. An own voice (voice clone) may be created only from your own voice: when recording, you read out a declaration of consent. Cloning another person's voice is prohibited, even if you make the recording. An own voice can be used only by the user who recorded it, and deleting it takes it out of use immediately.
- Another person's likeness and voice. You must not produce content that depicts or voices a real person in a misleading way, or that creates the impression that the person said or did something they did not.
- Uploaded video. You may use as a reference video, or for transformation (video to video), only footage you are entitled to use. Point 1 applies to the persons appearing in it, and intellectual-property rules apply to any music, trade marks and other protected content in it.
- AI music and podcasts. Generated music and speech must not recognisably imitate an existing performer, voice actor or protected work. You are responsible for checking the output — including factual statements in a podcast script — and for the lawfulness of its use.
- Marking obligation. The Service does not currently apply a machine-readable marking or watermark to generated image, audio and video output. If you publish the resulting content, you are the deployer under the EU Artificial Intelligence Act, and disclosing its artificial origin is solely your responsibility.
- Credits and limits. Image, video, audio and music generation consumes AI credits; video is priced per second, at a rate that depends on the model chosen. The number of clips that can be produced per day is capped per workspace. Credits consumed are non-refundable.
- Accuracy. A generated likeness is not a photograph, and a generated voice is not a recording. It may differ from reality and is not suitable for identifying a person, for use as a document photograph, or as evidence.
12. AI Meeting Notetaker
The notetaker joins video meetings as a clearly labelled bot participant, records the meeting and produces AI-generated notes. By inviting or enabling the notetaker you confirm that you have informed all meeting participants of the recording and obtained any consent required by applicable law; you are solely responsible for the lawfulness of each recording.
Transcripts are produced by automated speech recognition and may contain errors — AI-generated notes are assistance only and must be reviewed before you rely on them.
Notetaker usage is metered per started minute of the call and deducted from your workspace’s AI credits at the rate shown in the product; metering stops when the call ends.
We may suspend the notetaker where we reasonably believe it is being used unlawfully.
13. Third-party services and integrations
The Service may interoperate with third-party services (such as Google Workspace, Microsoft Outlook, Stripe, and automation tools). Your use of those services is governed by their own terms and privacy policies, and you are responsible for complying with them. We do not control and are not responsible for third-party services, and we are not liable for their availability, acts or omissions. We have not reviewed all sites linked from the Service and do not endorse them; use of linked sites is at your own risk.
You link Connected Services to the Service with your own account, in your own right and at your own risk. You warrant that you are entitled to use the account concerned and the data stored in it for this purpose, and that the connection does not breach the third party's terms (including in particular the Meta Platform Terms, the Google API Services User Data Policy, and the terms of service of Stripe, Dropbox, Számlázz.hu, Billingo, UNAS, WooCommerce, Shoprenter, MiniCRM, Asana and Trello). You are liable towards the third party for the fees, costs and legal consequences arising in the connected account.
13.1. Your own keys and tokens
Where the connection is made with an API key or access token you provide, you generate the key with the third party and you are responsible for choosing its scope (for Stripe we expressly recommend a restricted key), for managing it and for revoking it. We store the key or token encrypted, use it solely for the requests of the given integration, and delete it when the connection is ended. If the key falls into unauthorised hands, revoke it with the third party without delay and notify us.
13.2. Invoicing integrations (Számlázz.hu, Billingo)
An invoice or proforma invoice issued through the Service is created in your own invoicing account, in your name, in your own invoice series and with your own tax-authority reporting; you are the issuer of the invoice. The Service transmits the data you provide to the invoicing system; you are responsible for the correctness of that data — including the buyer's details, the line items, the VAT rates, the fulfilment date and the payment due date — and for accounting and tax compliance. A document prepared by an automation is issued only after your approval. We are not liable for the errors, availability or fees of the invoicing system.
13.3. Payment integration (your own Stripe account)
If you connect your own Stripe account, the Service may, on your instruction, create payment links and checkout pages in it and prepare summaries of your revenue and open invoices. The amounts collected this way arrive directly in your Stripe account; we do not hold, transfer or refund money, and we are not a party to the relationship between you and the payer. You are responsible for the correctness of the product, price and terms shown on the checkout page, for consumer-protection and tax compliance, and for complying with Stripe's terms.
13.4. File storage (Dropbox)
The Dropbox connection is read-only: the Service searches and lists your files and — for AI answers — reads the content of smaller text files; it does not upload, modify or delete anything. You are responsible for being entitled to use the files stored in the connected account, and for what content is processed when you allow the AI to read them. Once the connection is switched off, the Service no longer uses the Dropbox access; we recommend that you also revoke the permission in Dropbox.
13.5. Ad accounts (Meta Ads, Google Ads) and Meta Lead Ads (updated)
A Google Ads ad account is connected read-only by signing in with a Google account, and the connection is becoming available gradually: the Service shows and analyses the spend and results of the selected account's campaigns, but changes nothing in the account, does not create or launch campaigns and does not initiate ad spend. Connecting a Meta Ads ad account is in preparation; before it becomes available, we will set out its terms in these Terms. Through the Meta Lead Ads connection, the data of prospects coming from your ads is delivered to your workspace; you are the controller of that data: you are responsible for the notice and legal basis attached to the lead forms, and for complying with Meta's advertising and platform policies. We are not liable for the decisions of the advertising platforms, such as restricting an account or rejecting ads.
13.6. AI actions in Connected Services
On your instruction, the AI Features may perform actions in Connected Services (for example create a payment link). You set the AI's autonomy level in your workspace: by default such an action runs only after your confirming click; if you choose a higher autonomy level, the action may be carried out without confirmation, and you are responsible for its consequences. The Service issues invoices only with your approval. The disclaimers in section 11 apply to these actions as well.
13.7. Webshop integrations (UNAS, WooCommerce, Shoprenter, Shopify) (updated)
A webshop is connected with a read-only API key provided by you. The Service imports the products, synchronises the orders and creates a contact and a deal in your workspace from each new order; it changes nothing in the webshop. You are the controller of the buyers' data, and providing the required notice and legal basis is your responsibility. Synchronisation depends on the webshop's availability and API limits; we are not liable for the operation of the webshop or the accuracy of its data. A Shopify store can be connected using the ID and secret of an app created in Shopify.
13.8. Data migration (MiniCRM, Asana, Trello)
Data migration imports the data stored in your previous system at your request, with the access you provide; it changes nothing in the source system. You warrant that you are entitled to transfer the data. The import is subject to the quantity limits shown in the product, and the mapping — for example the matching of fields and assignees — may differ from the source system, so you must check the result before relying on it.
13.9. Partner applications and MCP clients
You may connect an external application (partner application) or your own AI client (for example Claude or ChatGPT) to your workspace through Gammatica's OAuth authorisation: you sign in, choose the workspace and approve access; the application never receives a password. Access follows your membership and role and can be revoked at any time among the workspace's connected applications. An application or client connected in this way does not act on our behalf in performing these Terms: it processes data under its own terms. You are responsible for the actions it performs on your instructions — including creating and modifying data and generations that consume AI credits — and we are not liable for its operation or availability.
13.10. Webshop storefront
You can build a webshop storefront in the Service from your own products, through which buyers can place orders. The contract concluded through the storefront is made solely between you and the buyer; we are not a party to it and act neither as seller nor as intermediary. The seller's obligations rest with you, in particular displaying products and prices correctly, consumer information (including information on the right of withdrawal), publishing your own terms and conditions and privacy notice, invoicing and taxation, fulfilment, and handling warranty and guarantee claims. Card payment takes place exclusively through your own Stripe account (Section 13.3): the purchase price goes directly to you, and we do not handle, hold or transfer money. Without a connected Stripe account there is no card payment, and you confirm the order yourself. You must not offer on the storefront any product or service whose sale is prohibited by law or by the AUP.
13.11. Publicly published content and notice of illegal content (updated)
Through the Service you can publish publicly accessible content — such as websites, landing pages, forms, booking pages, webshop storefronts, presentations and proposals — at an address we provide (for example on sites.gammatica.com or on gammatica.ai subdomains) or on your own domain. For such content we act as a hosting service provider; you are responsible for the published content, its lawfulness and the mandatory information relating to it (for example a legal notice, a privacy notice, cookie consent and, for forms, any required consent).
Deposits on the booking page. (new) If you ask for a deposit on your booking page, payment is made in your own Stripe account and the money goes directly to you; the Service Provider does not handle, hold or transfer money. You set the cancellation and refund rule and are responsible for it towards your guests; refunds are made from your Stripe account.
Anyone who believes that content published through the Service is illegal may notify us at [email protected]. The notice should contain an explanation of why the content is illegal, its exact location (URL), the notifier's name and email address (which may be omitted when reporting child sexual abuse material), and a statement that the notifier is acting in good faith and that the information in the notice is, to the best of their knowledge, accurate and complete. We process notices without undue delay, diligently and objectively, and inform the notifier of our decision. If we remove or disable access to content or restrict an account, we inform you, stating the reasons and the available means of redress, and you may lodge a complaint against the decision at the same address. If content indicates a criminal offence threatening the life or safety of persons, we inform the competent authorities.
13.12. Mailboxes (Gmail, Outlook, own IMAP/SMTP) (new)
Several mailboxes can be connected per workspace, including your own IMAP/SMTP mailbox. A mailbox may be connected only by someone entitled to do so. By default, the email in a connected mailbox is visible only to the user who connected it; if that user extends visibility, other members of the workspace can also access the email, and that user is responsible for this. Email sent from the Service leaves from your mailbox; the owner of the domain is responsible for the domain's delivery settings (SPF, DKIM, DMARC).
13.13. The AI machine (new)
- The service. The AI machine is an isolated browser running in the cloud, provided by the Service Provider, which at your express request performs operations on websites on your behalf (for example searching, collecting data, comparing prices, filling in forms, logging in to your account). The AI machine is your tool: you initiate the operations and they take place on your behalf. These capabilities are being made available gradually; during the free trial, use is limited (one smaller, read-only task per day).
- Approval and takeover. Data is sent (for example a form submitted) only with your approval, or under an "Always on this site" rule you have authorised in advance, which is valid until revoked. Your approval is your statement that you wish to send the data shown on the approval card. You can take over, pause or stop the machine at any time. If you log in to an account on the machine yourself, you perform the login with your own login details.
- Your responsibility for third-party terms. You are responsible for using the AI machine only on websites and in ways that the terms of use of those websites allow. In particular, you may not use it on a site whose terms prohibit automated access or data collection; you may log in only to your own account or one you manage with express authorisation; and you may not enter another person's login details. The Service Provider may block certain websites for the AI machine — currently Billingo and Számlázz.hu, whose terms require the official connection — and the machine does not open banking, payment or checkout pages.
- Prohibited use. You must not use the AI machine for bulk or indiscriminate data collection; to send unsolicited messages (spam) through forms; to circumvent websites' security or access-restriction measures (for example CAPTCHA or paywalls); to send unlawful, misleading or infringing content; to overload websites; or to act on behalf of another person without authorisation. The prohibitions in Section 9 and in the Acceptable Use Policy also apply to the AI machine.
- Third parties' data. If you collect or process third parties' personal data with the AI machine (for example contacts listed on company websites), you are the controller of that data and are responsible for the appropriate legal basis and for informing the data subjects; the Service Provider acts as processor.
- Login details and sessions. The Service Provider stores the login details you save and the sessions remaining on the machine encrypted, and uses them only for tasks you start. An unused machine is deleted after 30 days, following prior notice by email; you can delete it at any time. Details are in Section 2.11 of the Privacy Policy.
- Fees. The AI machine uses credits in proportion to the run time and the AI resources used. We show the expected cost before the task; if the run would reach one and a half times the estimate, the machine stops and asks you.
- Limitation of liability. The Service Provider is not responsible for the content, availability or operation of websites, or for their operators' decisions (for example restricting an account if you breached the terms above). Data and results collected by the AI machine are for information only; Sections 11, 16 and 17 apply. The Service Provider may limit, queue or stop a run for security or capacity reasons, and may restrict or suspend use of the AI machine if abuse is suspected.
14. Intellectual property
All intellectual property in the Service and in all materials and marks contained in or connected with it are owned by or licensed to Gammatica Kft. and are protected by copyright, trademark and other laws. We have the exclusive right to license use of the content and interface of the Service, which may not be used or exploited other than as part of the intended use of the Service without our prior written consent.
If you provide feedback, suggestions or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without restriction or obligation to you.
15. Confidentiality
Each party shall treat as confidential any non-public information of the other party that it learns in the course of the relationship, shall use it only to perform under these Terms, and shall not disclose it to third parties, both during and after the term, except where disclosure is required by law or to professional advisers bound by confidentiality. This does not apply to information that is or becomes public through no fault of the receiving party.
16. Warranties and disclaimers
The Service and all materials are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure. Materials in the Service are for general information only, and we make no representations about their accuracy, reliability or results. We may perform maintenance and may experience downtime, and we exclude liability where the Service is unavailable for reasons beyond our reasonable control.
17. Limitation of liability
To the maximum extent permitted by law, neither party is liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, business or data, arising out of or relating to the Service, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Service is limited to the total fees paid by you to us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Hungarian or EU law, including liability for intentional breach, for damage caused by gross negligence, or for harm to life, bodily integrity or health.
18. Indemnification
To the maximum extent permitted by law, you will indemnify, defend and hold harmless Gammatica Kft., its officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to: (i) your or your Authorised Users’ breach of these Terms or the AUP; (ii) Customer Data, including any claim that it infringes third-party rights or was processed without a valid legal basis; or (iii) your use of the Service in violation of applicable law or third-party rights.
19. Beta and early-access features
We may make features available on a beta, preview or early-access basis. Features marked “in preparation” are not part of the Service until they become available, and no claim can be based on them.
20. Modifications to the Service
We may unilaterally modify, revise, further develop or discontinue the Service or any part of it at any time. We are not obliged to notify you in advance of routine modifications; it is your responsibility to stay informed of changes. We will use reasonable efforts to avoid materially degrading core functionality you rely on during a paid Subscription Period.
21. Force majeure
Neither party is liable for any failure or delay in performance (other than payment obligations) caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labour disputes, failures of telecommunications or internet providers, hosting or third-party service outages, cyber-attacks, or government action.
22. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation or sale of assets, subject to the Privacy Policy.
23. Entire agreement and order of precedence
These Terms, together with the AUP and the Privacy Policy, constitute the entire agreement between the parties regarding the Service and supersede prior agreements on the subject. If there is a conflict, these Terms prevail over the AUP and the Privacy Policy with respect to contractual rights and obligations, except that the Privacy Policy prevails on matters of personal-data processing. Our failure to enforce any provision is not a waiver of it.
24. Severability
If any provision of these Terms is wholly or partly void or unenforceable, it is severed to that extent, and the remaining provisions continue in full force.
25. Notices and complaints handling
Notices to us may be sent to [email protected]; we may give notices to you by email or through the Service. We will respond to a written complaint about our activities within 15 days of receipt at one of our official contact details, indicating the available remedies and time limits. Where the nature of the complaint requires further investigation, the deadline for investigation is 15 days.
26. Governing law, jurisdiction and language
These Terms are governed by and construed in accordance with the laws of Hungary, excluding its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the competent courts of Hungary. In the event of any discrepancy between language versions of these Terms, the English version prevails unless mandatory law requires otherwise.
